Service Agreement
1. Completion dates and duration of services
The execution of services will take place between April 1 and November 15 of each year. The date of each individual visit at the service address will be determined at the discretion of the service provider based on criteria including, but not limited to, weather conditions, availability of products, the presence of a technician in the area and the optimal time of application of a specific treatment.
2. Execution of services
The order of treatments and number of visits listed on the service agreement are indicative only. The service provider reserves the right to change the order of the treatments and eliminate visits by combining the application of several treatments in a single visit without prior notice to the customer.
3. Payment Terms
Contracts are payable by cheque made out to Monsieur Gazon at 809, boulevard St-Luc, Saint-Jean-sur-Richelieu, QC, J2W 2G6 or by credit card (Visa or MasterCard) by phone at 1-888-348-9332 or mgazonsecure.ca on the website.
Possible payment arrangements are payments in one or more installments, monthly payments and payments per visit. Monthly payment arrangements are generally made from May to April of each year.
4. Customer Obligations
The customer agrees to give the service provider free access to the property covered by the services. The service provider reserves the right not to apply treatment to areas that are not easily accessible or that may represent a risk to the safety or welfare of the technician, occupants or pets.
5. Penalties
In case of payment default, the service provider reserves the right to discontinue the customer’s lawn care services. A payment is considered to be late if the payment period exceeds 30 days from the billing date. In such a case, the customer must, at the express request of the service provider, pay interest. The interest payable is calculated from the first day the amount became overdue, at a monthly rate of 2%.
A fee will be charged by the service provider for NSF cheques or any credit card payment that is declined.
6. Termination of the contract and penalties
Both parties may, at any time and for any reason, terminate the service contract.
Upon termination of the service contract by the customer before any service and/or treatment has been executed by the service provider, the service provider will cancel the contract and refund the customer in full. Administrative fees of twenty-five dollars ($ 25) are payable for file closure for first year service contracts (if said contract has never been renewed).
In all other cases of termination of the service contract by the customer, the service provider is entitled to demand payment of all services rendered at regular price; to claim compensation for the remaining contracted services; and to completely cancel any and all discounts afforded for the service contract. The compensation payable is ten percent (10%) of the value of the remaining service contract up to a maximum of fifty dollars ($ 50).
7. Automatic Renewal
The service contract will be automatically renewed on April 1st of each year. A copy of your new contract will be sent by March 1st of each year. Prices and treatment programs be modified each year. To cancel the contract without penalty in the case of an automatic renewal, the customer must cancel before the technican’s first visit. (See 6. Termination of the contract and penalties)
8. Contract Acceptance
The electronic or verbal acceptance of Monsieur Gazon services by the customer, under the terms of this service contract, is as binding as a signature. It is the customer’s responsibility to read and understand the terms and conditions of this service agreement.
